距离正式实行发票制度还有2年

首先

从今年10月1日起,开始接受开票企业的注册申请。申请后的企业信息将会依次刊登在国税局的官网。根据两年后实行的发票制度,消费税课税企业或个人必须要注册登录后才能发行正规发票。这将是日本消费税的重大转折点。

免税经营者面临决策压力

2023年10月1日后施行的发票制度下,只有保存正规发票才能被允许抵扣消费税。

想成为正规开票企业或个人经营者,需要向所在地的税务署长提交。但是仅限课税企业或个人经营者才能被正式登录。免税企业或个人则无法被登录。

免税企业或者个人经营者要想登录的话,需要先提交成为课税企业或者个人的申请书。但是发票制度开始后,免税企业或者个人在包含2023年10月1日的课税期间中申请登录正规开票,即日起即可成为课税法人(通常规则需要在课税期间开始前申请才能生效)在这个经过措施下,不需要额外提交选择课税的申请。

这只不过是包含2013年10月1日的课税期间的特别政策,在这之前或者之后的课税期间都不能适用。即,需要额外提交申请成为课税法人。

必须注意的地方

适用经过期间措施儿成为课税法人和正规开票企业的,无论销售额多少,都需要在课税期间的后提交消费税申告书。

比如,2023年12月结算的免税企业在2023年10月1日登录成为正规开票企业,那么登录当天到12月31日之间的交易,需要进行消费税的申报。

另一方面,如果按照原则来处理,在2022年中提交成为课税法人的申请书。虽然在10月1日之后才能开正规发票,但是从1月1日到12月31日整一年度的交易都需要提交消费税申请书。

也就是说,采用不同的手续将会导致,2023年1月1日到9月30日的期间内是否需要缴纳消费税的差异。采用第二种方法的,可能会比前一种方法多缴纳9个月的消费税(当然也有可能会获得更多的消费税抵扣)因此,消费税课税申请书和正规开票企业登录申请书都不是随便提交的。不事先进行严谨的分析,反而可能导致意想不到的税务负担。

事业重组补助金该何时记成收益

首先

为了支持在新冠疫情阴影下中小企业的事业重组而设立的最大一亿日元的补助金,并非免税。请注意,是需要作为企业利润缴纳法人税的。

补助金等收益计入时期为归属时

一般来说,公司从国家或地方政府获得的补助金等收益计入时期是 "确定获得收入权利的财政年度",具体来说是 "确定提供补贴决定的财政年度"。

在事业重组补助金的情况下,虽然有经费填补的性质,但是实际支持经费和收到补助之间存在时间差异。只有在管理事务局收到补助事业实绩报告书的设备投资等所需费用的收据等,确认该收据支出正当后,才会确定补助金额以及进行转账、结算。

因此,拨款决定的日期和确定拨款金额的日期之间存在差异的情况下,事业重组补助金的收益计入时期就是拨款金额确定时的财政年度。如果在X财政年度支付费用,在X+1财政年度确定拨款金额,那么在X+1事业年度中,补助金全部作为收益计入法人税的应税收入。

被征税的情况是

例如,如果一个补助金项目上花费了1.5亿日元,并收到1亿日元的补助金收入,而在补助金项目的X财政年度有1.5亿日元的赤字(亏损结转),那么即使在X+1财政年度收到1亿日元的补助金收入,结转的亏损也可以抵消赤字,就不会马上产生纳税的情况。

另一方面,充分设想补助金项目上支出经费的X财政年度中,赤字(结转亏损)只发生了0.1亿日元的情况。

当一个项目涉及固定资产的购置时,就会出现这种情况。 在购置固定资产的情况下,花费的金额通过折旧在资产的使用寿命内支出,因此,即使花费1.5亿日元购置价值1.5亿日元的固定资产,只能记录0.1亿日元的折旧。

这种情况下,如果在X+1财政年度获得1亿日元的补助金收入,即使利用X财政年度产生的亏损金的转入扣除,也会产生0.9亿日元的应税收入。

压缩记账的探讨

好不容易得到了1亿日元的事业重组补助金,0.9亿日元将很快成为征税对象,并要缴纳0.27亿日元(0.9亿日元)×假设法人税率为30%)法人税。作为这种情况下的对应策略,有必要探讨适用“压缩记账”。关于压缩记账的详细内容我们不谈,但是通过适用压缩记账,有可能避免对补助金收入立即上税的情况。但是请注意,这并不意味着补助金收入在中长期内不需要缴纳公司税。

电子交易制度修改案的对应

修订后的电子交易系统将于明年1月开始实施,在进行电子交易时将取消纸质输出的存储,并要求存储电子数据。

例如,如果同时收到电子发票和书面的发票,应该保留哪一种? 是否必须以各自的格式保存两者?

用电子数据将所有收到的多个文件以电子方式保存

与电子交易的交易信息有关的电磁记录保存制度要求有义务保存 "电子交易 "的人在电磁记录形式来保存电子交易的信息。

例如,电子邮件中附上账单等PDF进行收发的交易也属于电子交易,因此已经有很多企业实际上进行着电子交易。

作为原件收到的书面材料不需要电子保存

进行电子交易的情况下,有义务保存交易信息的数据,不仅仅是电子数据的受领方,交付方也有保存的义务。

作为交付发票人员工作流程的一部分,有时可能会在Excel或Word中创建发票,打印出来,加盖印章,转换为PDF或其他格式,并通过电子邮件发送给客户。 在这种情况下,只要发票和其他 "交易信息 "通过电子邮件以PDF数据形式发送,就属于 "电子交易 "的范畴,数据需要以符合存储要求的方式存储。
