2022年度税制改正大纲确定

首先

2022年度税制改革大纲已经敲定,通过税法来促进企业提高工资作为岸田政府的一个重要方针,将从2021年的修改开始连续2年进行彻底的修改。

个人所得税中对住宅贷款扣除率等进行了调整

关于住房贷款扣除,适用期限将延长至2025年12月31日4年,并对2022年至2025年期间购置住房并居住的人员的住房贷款年末余额限额、扣除率和扣除期限作如下调整等。另外,适用对象的收入要求将降低到2000万日元或以下(目前是3000万日元或以下)。关于住宅贷款扣除,借款利息以低于1%的水平推移,另一方面,余额的1%可以作为住宅贷款扣除,也就是说,以前会计检查院指出的倒卖问题成为了此次修改的对象。

通过加强工资增长税制中小企业扣除率高达40%

关于被称为提高工资税制的中小企业的所得扩大促进税制,将延长一年,税收抵免率将提高如下。 这样一来税收减免将提高到最高40%。

对雇佣者的工资支付额比上一年度增加2.5%以上,税额扣除率上加15%。
教育培训费用比上一年度增加10%以上,税额扣除率加10%。

除了工资和教育培训费用的增加可以作为可扣除的费用外,还可以享受最大工资增加额的40%的税额扣除。这是以扩大员工收入为目标的岸田政权最引人注目的修改项目。

另外,关于关于小额折旧资产的取得价格的计入亏损制度,用于租借给人的取得价格低于10万日元的折旧资产不包括在标的资产中,①一次性摊销资产的折旧制度、②中小企业等的小型可折旧资产按照取得价格计入损金的特例,若是用于租界给他人也将被排除之外。

通过购置无人机或LED等小额并且计算成亏损的物品,并将其出租来节税(和推迟纳税)的架构将完全失效。

修正电子交易制度的宽松措施

首先

从2022年1月1日起,以满足检索条件等保存条件的形式,有义务保存电子交易信息相关的电子数据,但考虑到经营者的系统对应,采取一定宽松的措施。

到2023年为止的宽松措施

对于截至 2021 年 12 月 31 日的电子交易,采取措施输出发送和接收的发票等电子数据,并允许以书面形式存储这些数据。随着2021年税制改革,该措施被取消,当日后电子交易无法保存书面印刷,并强制要求以符合检索条件的形式保存电子数据。

我们在这里已经多次介绍过修订后的电子交易制度。 然而,即使离修正案的实施还有不到一个月的时间,仍有一些人表示他们不知道修正案的内容,无法及时准备。 在11月17日举行的政府税务委员会第七次会议上,有人要求从准备时间的角度考虑安抚等措施。

11月29日,在自民党税制调查委员会上,经济产业省表示,“从促进申报和纳税等税务程序进一步计算机化的角度来看,应该对电子簿记法规定的电子交易存储和税务审计数字化的相关系统进行必要的改进,以利于减轻公司的行政负担"。

其结果是,根据2022年度税制改革,对于2022年1月1日至2023年12月31日这2年间的电子交易,即使不得已无法充分满足保存条件,也要允许其保存。
由于修订后的电子交易系统将在年初生效,看来政策是在年内修订并采取行政法案等措施。

通过这次修改,将有效地允许从2022年1月1日起的电子交易继续像以前一样以书面形式存储。

税务调查时提出的申请

要获得该宽松措施,需要税务署长认可该企业因存在不得已的情况,无法按照保存要求来保存文件。 有些人想知道是否需要在修订后的电子交易系统开始之前,即在年底之前向主管税务局提出申请,但似乎不需要事先申请,就可以应用这项措施。 因此,没有必要在年底前做任何特别的事情。

税务调查的时,如果未能以满足存储要求的方式存储电子数据,企业方面会以不得已难以应对为由提出适用该措施。目前还不清楚如何证明迫不得已难以应对的情况,但原则上将接受这一请求。

当然,在这个时间点上,宽松措施只持续到2023年12月31日,之后数据将必须以电子方式存储。两年后有可能采取进一步措施,但由于两年的措施,自然认为不会进一步延长。
有必要在两年之间采取切实可行的形式。

对发票制度的准备

另外,在发票制度开始之前,可以交付记载了发票信息的文件,并提供数据。在制度开始之前,在发票上列入注册号码并不影响买方提出的购买税收抵免要求。

此外,与发票制度相关的员工培训是必不可少的。最好在公司内部指定一个负责人,以及一个可以处理客户咨询的人。
