以公司名义租赁的住宅也能成为房租支援补助金的对象

首先

如果满足一定条件,公司住宅和员工宿舍好像可以成为房租支援补助金的支付对象。不过,要满足什么样的条件才可以呢 ?

「转租」的情况不在对象内

房租支援补助金是指,受新型冠状病毒感染扩大的影响政府发令了紧急事态宣言,因此为了减轻其销售额大幅减少的中小企业等地租和房租的负担,而创设的税制。

法人最多补助600万日元,个体经营者最多补助300万日元。这项房租支援补助金支付条件之一是「对为自己的事业专用的土地或建筑物所支付的相关租金」,因此公司为董事和员工租借的公司住宅和员工宿舍的租金是否成为支付对象已发生了很大的混乱。

关于这件事,经济产业省的主页上如下所示。

“法人根据租赁合同等,租借公司宿舍用的房子,让员工居住,该房子的租金在该法人年度申报时做为费用地租和房租记账的话,原则上为支付对象。另一方面,根据租赁合同转租给员工的情况要除外”

造成混乱的原因是什么?

发生混乱的是这一部分「另一方面,根据租赁合同转租给员工的情况要除外」

企业为董事或员工租赁住宅的情况下,为了避免个人所得税,最常见的做法就是从工资里扣除个人所承担的部分租金。也就是说在实际业务上,企业将公司住宅转租给董事和员工是很正常的。

因此,有消息说,公司住宅和宿舍是房租支援补助金的对象外。另外,实际上在SNS上也经常能看到,来自呼叫咨询中心的回答是不属于支付对象的。

如果不是一般的房租价就不是“转租”

为了避免缴纳个人所得税,向董事和员工征收“租金的相应金额(根据固定资产税的税收标准计算)”,或者“收取租金的50%”,则不属于转租。征收与公司支付的房租同等的租金则视为转租。

因此,在实际业务上,企业租借的公司住宅等也满足其他条件,通常是可以成为房租支援补助金的支付对象。

日本税理士会联合会的会员页面上也刊登了本次记载的内容,但是好像还有人理解有误。

如何组建不发生舞弊的公司内部体制

不论公司的规模大小,董事和员工不正当行为被发现的案件将永无止境。特别是经济不景气的影响是开始出现的时期,应该特别注意。受冠状病毒的影响,预计不得不推迟加薪和奖金。在这种情况下,经营者必须注意管理人员和员工的不正当行为。

当然,不管景气是好还是坏,都必须采取必要的措施,但在不景气的时候更加需要谨慎。

有贪污行为时的税务处理

假如发现董事和员工贪污,公司应该向其要求赔偿损失。但在许多情况下,「不正当所得的钱已用于饮食费」。
